Terms of Use

The short version
- Nimzo is free to play, with ads and optional in-app purchases.
- Play by the rules: no cheats, mods or bots. We may remove cheated scores and block players from leaderboards.
- Apple and Google handle payments. You can restore Remove Ads and themes at any time in Settings.
- Focus packs are consumable, and virtual items have no cash value.
- Nimzo is a game. It isn't a medical, therapeutic or brain-training product.
- These terms are governed by the laws of India. On iPhone, they add to Apple's standard license for App Store apps, which has its own governing law.
1. Agreement
These Terms of Use ("Terms") are an agreement between you and Touheed Khan, an independent developer in Bengaluru, Karnataka, India ("we", "us"), about the Nimzo game for iPhone and Android and our websites. By downloading or using Nimzo, you agree to these Terms.
If you got Nimzo from the App Store, Apple's Licensed Application End User License Agreement (the "Apple EULA") governs your license to use the app, including the law that applies to that license. These Terms add Nimzo's own rules, and where they conflict with the Apple EULA, the Apple EULA wins. If you got Nimzo from Google Play, the Google Play Terms of Service also apply. Our Privacy Policy explains how information is handled.
2. License
We give you a personal, non-exclusive, non-transferable, revocable license to use Nimzo on devices you own or control, for your own non-commercial entertainment, as the App Store's or Google Play's rules allow. You may not copy, modify, reverse engineer, decompile or redistribute Nimzo, except where the law expressly allows it.
3. Who can play
Nimzo is a general-audience game. It isn't directed at children under 13. If you're under the age of majority where you live, ask a parent or guardian before using Nimzo or making purchases. Parents can manage purchases with Apple's Screen Time and Family Sharing, or with Google Family Link.
4. Rules of play
You agree not to:
- use cheats, bots, automation, modified versions of Nimzo, or tools that change the game, its timing or its scores;
- change your device's clock, Nimzo's saved data or its files to gain an advantage or free items;
- submit scores you didn't earn by playing yourself;
- exploit bugs (please report them to us instead);
- fake purchases, or use fraudulent payments, refunds or chargebacks;
- create fake ad views or clicks, or use scripts or other tools to collect ad rewards;
- use Nimzo in a way that breaks the law or harms other players.
5. Leaderboards
Leaderboards and achievements are optional. They use Apple Game Center on iPhone and Google Play Games on Android, which have their own terms. iPhone and Android have separate leaderboards, and they show your Game Center or Play Games name. Nimzo has no usernames of its own.
The Daily Challenge is the same for everyone and starts every day at 07:00 UTC. Your first attempt of the day counts for the Daily leaderboard as soon as you start it, even if you leave it early. Later attempts that day are practice. Weekly leaderboards start every Sunday at 07:00 UTC.
Leaderboards are just for fun: Nimzo has no prizes, wagers or cash rewards.
To keep leaderboards meaningful, we may, without notice:
- remove scores that look impossible, cheated or manipulated;
- block or hide players from Nimzo's leaderboards, using the tools Apple and Google give developers;
- reset, replace or retire leaderboards, for example after a scoring change.
Nimzo checks runs before it submits scores, and it may hold back a score that fails its checks. If you think we removed a score by mistake, email us. We review every appeal by hand.
We don't promise that leaderboards, ranks, Game Center or Play Games will always be available or accurate. A score that can't be sent right away may be sent later, while that leaderboard's day or week is still open.
6. Focus
Focus slows time for a moment during a run. Each activation uses one Focus, even if Focus ends early, for example on a wrong answer, a pause or the end of the run. Answers given during Focus don't earn the speed bonus.
You can earn Focus by playing and from optional rewarded ads (up to 3 Focus a day from ads). On iPhone, you can also buy Focus packs. Earned and bought Focus work the same way, in every mode. In 60 Second Rush and in your counted Daily attempt, you can use at most one Focus per run.
We may change how Focus works, including how long it lasts, its limits and how you earn it.
7. In-app purchases
- What you can buy. Remove Ads and the premium themes Cyber, Retro and Paper (each on its own, or as a pack) are one-time purchases. Premium themes can also be earned by playing. On iPhone, you can also buy Focus packs. Focus packs aren't available on Android yet.
- Remove Ads turns off the full-screen ads between runs. Optional rewarded ads stay available, because you choose to watch them.
- Focus packs are consumable. The Focus a pack adds is used up as you activate it. Restore Purchases doesn't bring back Focus, and unspent Focus can be lost if Nimzo's data is deleted and not restored from a backup. If a Focus pack is refunded, we may remove any of its Focus you haven't used.
- Payment. Apple or Google sells and processes every purchase, under its own terms. Prices are shown in the store before you buy, in your local currency. They may include taxes, vary by country and change over time.
- Restoring. Use Settings › Restore Purchases (also at the bottom of the Themes screen), signed in with the same Apple Account or Google Account, to get Remove Ads and themes back on a new or reset device.
- Refunds. Apple handles refunds for App Store purchases: request one at reportaproblem.apple.com. For Google Play purchases, see Google Play's refund policies, or email us and we'll review your request.
- Nothing in these Terms limits your rights under consumer protection law.
8. Virtual items
Focus, XP, levels, streaks, achievements, companions and themes, whether earned or bought, are part of the game. You get a license to use them in Nimzo; you don't own them. They have no cash value, and they can't be sold, exchanged, transferred or redeemed for money or for anything outside Nimzo. We may change or rebalance them, but we won't take away items you paid for, except as these Terms describe (for example, unspent Focus from a refunded pack). Progress you've earned is stored on your phone and can be lost if Nimzo's data is deleted without a backup.
9. Ads
Nimzo shows ads from Google AdMob: full-screen ads at natural breaks between runs, never during a challenge, and rewarded ads that you choose to watch. A rewarded ad's reward (a revive in Endless, double XP for a run, or one Focus, up to 3 a day) is given after you've watched the ad, and is offered only when an ad is available. We aren't responsible for advertisers' products, services or websites. If an ad seems inappropriate, please tell us at contact.touheed@gmail.com.
10. A game, not a health product
Nimzo is entertainment. It isn't designed or tested to diagnose, treat or improve any medical, cognitive or mental health condition, and we make no such claims. Take breaks when you need them. If motion bothers you, turn on Reduce Motion (iPhone: Settings › Accessibility › Motion) or Remove animations (in Android's accessibility settings), and Nimzo calms its motion to match.
11. Intellectual property
Nimzo, including its code, design, themes, characters, artwork and audio, belongs to us or our licensors and is protected by law. The Sora typeface is used under the SIL Open Font License, and the licenses and credits are listed in Nimzo's Settings › About. Apple, iPhone, App Store and Game Center are trademarks of Apple Inc. Google Play, Google Play Games and Android are trademarks of Google LLC. You're welcome to share score cards and screenshots of your own games.
If you send us feedback or ideas, we may use them without any obligation to you.
12. Changes to Nimzo
We may update, change, rebalance or discontinue features, game modes, difficulty, scoring, Focus, themes or leaderboards. After a scoring change, older scores may no longer be comparable, and we may start new leaderboards. Older versions of Nimzo may stop submitting scores, so you may need to update to keep using leaderboards. If we remove Focus or a paid theme, we'll keep what you bought usable, give you an equivalent item, or tell you how to ask for a refund.
13. Disclaimers
To the extent the law allows, Nimzo is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't promise that Nimzo will be uninterrupted, error-free or free of harmful components, or that scores, ranks, Focus or progress will never be lost. Some places don't allow these exclusions, so they may not apply to you.
14. Limitation of liability
To the extent the law allows, we aren't liable for any indirect, incidental, special, consequential or punitive damages, or for lost progress, data, profits or goodwill, arising from your use of, or inability to use, Nimzo. Our total liability for any claim about Nimzo is limited to the greater of the amount you paid for Nimzo's in-app purchases in the 12 months before the claim, or USD 10. Nothing in these Terms excludes or limits liability that the law doesn't allow to be excluded or limited, such as liability for death or personal injury caused by negligence, or for fraud.
15. Apple and Google
If you use Nimzo on an Apple device: these Terms are between you and us, not Apple. Apple isn't responsible for Nimzo or its content and has no obligation to provide maintenance or support for it. If Nimzo fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the extent the law allows, Apple has no other warranty obligation for Nimzo. We, not Apple, are responsible for addressing any claims relating to Nimzo, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer protection claims and intellectual property infringement claims. You confirm that you aren't located in a country subject to a U.S. Government embargo, and that you aren't on any U.S. Government list of prohibited or restricted parties. When you use Nimzo, you must also follow the terms of other services you use with it, such as your mobile data provider's. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
If you use Nimzo on Android: Google isn't a party to these Terms and isn't responsible for Nimzo. Your use of Google Play is governed by Google's terms.
16. Ending these terms
You can stop using Nimzo at any time by deleting it. If you seriously or repeatedly break these Terms, for example by cheating on leaderboards, we may remove your scores, block you from Nimzo's leaderboards and stop providing online features to you. This doesn't take away items you paid for, unless they were obtained by fraud or refunded. The sections on virtual items, intellectual property, disclaimers, limitation of liability and governing law continue to apply after these Terms end.
17. Governing law and disputes
Apart from the Apple EULA, which has its own governing-law terms, these Terms are governed by the laws of India. Subject to your rights as a consumer, the courts at Bengaluru, Karnataka, have exclusive jurisdiction over any dispute about Nimzo or these Terms. If you're a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring claims in your local courts. Before going to court, please email us, so we can try to sort things out first.
18. Changes to these terms
We may update these Terms, for example when we add features. We'll post the new version here with a new date, and for material changes we'll give reasonable notice, for example in the release notes or in the app. If you keep using Nimzo after a change takes effect, the updated Terms apply.
